Section 283: Any person who attempts to unlawfully kill another or with intent to unlawfully kill another does an act (or omits to do an act which it is their duty to do) and the doing or omitting to do that act is likely to endanger human life, the person is guilty of attempt to murder.

The maximum penalty is life imprisonment.

(1) That the accused had an intent to kill at the time of the offence;
(2) That an act was done which shows that they had put the intention to kill into execution; and
(3) That there was some overt manifestation of the intention to kill.

(a) There was no intention to kill;
(b) No act had been done to put the intention to kill into execution;
(c) The act done could not have killed the person and the accused knew this;
(d) Insanity;
(e) Accident; and
(f) Identification (ie. The accused is not the person who intended to kill the victim).

The matter would be heard in the Supreme Court.
