is undergoing the most extensive change in decades. Basic criminal procedure and the main laws such as the Crimes Act 1958 are being modified and parts are being deleted. A number of problem areas are hopefully to be fixed by the new Criminal Procedure Act.
This does bring a greater complexity to criminal law in both procedure and practice here than has been the case previously.
In certain areas of law such as sexual offending cases the law is becoming more and more complex and more impediments are being placed in the way of accused people. There are special pre-trial taping of evidence of certain complainants. There are notices that have to be filed if certain questioning is intended and there are new procedures for obtaining confidential communications. All these make it more important than ever to be represented by someone who only handles criminal cases.
The large majority of criminal trials in Victoria are handled by the larger specialist criminal law firms.
Drink driving laws in Victoria are covered by the Road Safety Act 1986 and it is also a very complex and detailed act.
There are other acts such as the Drugs Poisons and Controlled Substances Act 1981 and Summary Offences Act 1966 which are frequently the basis for criminal charges.
