An Article about Drink driving penalites and whether conviction recorded for earlier offence


Victoria operates under a mandatory regime of license disqualification for drink driving offences.  The period of disqualification applicable depends upon the blood alcohol concentration reading and whether the offence is a first or subsequent offence.

The effect of the decision in DPP v Norman [2003] VSC 399 is that an offence occurring after a previous offence, is to be taken as a subsequent offence attracting an increase in the minimum disqualification, even if no conviction (for the earlier offence) is recorded.
